👨⚖️ BREAKING NEWS: The Czech Constitutional Court took the side of the smaller political parties and has stricken down discriminatory rules!
▪️ Prague, February 3, 2021 - The votes of the electorate haven’t had the same weight in the parliamentary elections, the Constitutional Court of the Czech Republic confirmed today. Pirates welcome the court's decision, as they have been pointing out for several years that the proportional system used in the elections to the Chamber of Deputies disproportionately helps larger parties at the expense of smaller ones. The smaller ones had to get a significantly higher number of votes to win one seat. The Constitutional Court therefore abolished use of the D'Hondt's Method of converting votes into seats. In addition, it repealed the Additive Clause, which restricted the cooperation of political groups in elections, raising the 5 % threshold to 10 or more depending on the number of parties on a joint ticket.
💬 "The Constitutional Court confirmed the long-standing opinion of both Pirates and STAN that the votes must have the same weight and that the proportional system used was discriminatory. E.g. the PM’s ANO movement needed less than 20,000 votes to get one mandate in 2017, while the STAN movement, just getting over the 5% threshold, need double of that. It is a bit unpleasant that the court ruled three years after the lawsuit began, right at the beginning of the election campaign, but this is a solvable situation. I believe that we will find a quick agreement in both the House and in the Senate. Of course, the verdict of the Constitutional Court does not change the coalition cooperation between the Pirates and the STAN," said the Chair of the Czech Pirates, Ivan Bartos.
💬 "The court correctly described the current method of converting votes into mandates, which we have criticized for years, as discriminatory. The Additive Clause, which was a remnant of the so called Opposition Agreement back in the ‘90s and whose discriminatory nature we have also drawn attention to, has also been abolished. It distorted fair political competition and restricted the cooperation of political parties. The Pirates, together with STAN, are now ready to act on the floor of the Parliament to quickly amend the election law, parts of which were now stricken down. The goal is to preserve the electoral system according to the existing self-governing regions, while respecting the equality of votes and proportionality of the system," said Deputy Speaker of the Chamber of Deputies Vojtech Pikal (Pirates).
▪️ The elections into the chamber of deputies should take place in October of this year and the law has to be fixed accordingly before summer, but the Czech Pirates are optimistic that a new model will replace the old one quickly. Abolition of the use of the D’Hondt method isn’t technically a good news, considering the Czech Pirates are one of the biggest parties now, but it’s the right thing to do and the Pirates have been fighting for this change for years now, and not only in the Czech Republic. ...
